In Georgia, the statute of limitations—or deadline—for bringing any personal injury lawsuit is two years from when the injury or death occurred, but there are differing time limits for filing medical malpractice claims, depending on the type of case and the age or status of the claimant.</p>
<p>Georgia law also has a statute of repose, which means that a medical malpractice action cannot be brought if it has been more than five years from the negligent or malpractice incident.</p>
<p>An exception to the usual time limitations on filing medical negligence cases is in the case of a foreign object that was left in the patient. Most of these cases involve surgical sponges that are left in a patient’s body cavity. There are instances in which patients have suffered for years before discovering the object still lodged within their body. In these cases, Georgia law says that you can bring a malpractice action any time within one year from the time that you discover the foreign object.</p>
<p>These time limitations apply to minors, but the statute of limitations will not run before a child’s seventh birthday, and the statute of repose will never run before the child’s tenth birthday, so minors have additional time to file a suit after they reach these ages.</p>
<p>Should a claimant be determined to be mentally incompetent or retarded, the statute of limitations is tolled, but a malpractice action must still be brought no later than five years from the date that the alleged negligence or misconduct occurred.</p>

			<content:encoded><![CDATA[<p>In Georgia, a premises liability claim refers to any injury that is incurred while on someone else’s property and sustained as the result of the owner’s breach of their duty of care. For example, if you were injured by a hazardous condition that you were not warned about, such as a slippery floor, or were assaulted by someone on their property, then you may have a premises liability claim.</p>
<p>A claim for injuries in a premises liability case depends on your status. Department store customers, restaurant patrons, or contractors doing work all are invitees since they are invited to do business on the property. An owner has a duty to exercise ordinary care toward invitees to keep the property safe from hazards and defects.</p>
<p>You are a licensee if you are a social guest and are on the property for social reasons, although a fireman fighting a blaze is also a licensee, as is a salesperson making a house call. As a licensee, you are invited on the property but have no business relationship with the owner. To show liability, the owner must have had knowledge or should have known of the defective condition or hazard and failed to remedy it or provide a warning. The owner’s duty of care, however, increases once the owner is aware of the licensee’s presence. At this point, the owner must exercise ordinary care in protecting the person as if he or she was an invitee.</p>
<p>Finally, there is the trespasser. If you were not invited onto the property or wandered there, the owner only owes a duty not to willfully or wantonly harm you from any hidden hazards. The owner’s duty of care changes, however, if the trespasser is a child who is unable to recognize dangerous conditions, also referred to as “attractive nuisances.” These can include old appliances or sharp tools, or an uncovered swimming pool with no gates or security devices. Allowing the child access to the hazard can render the owner liable for any injuries.</p>

<p>The first element you must prove is that another person or entity was negligent or careless toward you. You need to show that the defendant owed a duty of care to you and that the defendant breached that duty by not adhering to the standards of a reasonable person. For instance, all motorists have a duty to operate a car as a reasonably prudent driver would under similar circumstances. Auto damage can be proved by an estimate from a body shop or testimony from a mechanic. Medical treatment and costs must be necessary and reasonable. A physician who treated you, or one who is familiar with similar care, can offer testimony regarding the necessity and value of your medical care and bills along with your certified medical records and bills.</p>
<p>If you have an income loss, you must produce your employment records and your physician’s testimony or documentation that your injuries prevented you from working at your job. An economist might have to testify as to the value of your loss of future earnings.</p>
<p>Another aspect of damages are general damages—or pain and suffering—which you can prove by your own direct testimony as to your symptoms, medications taken, and inability to engage in your normal, daily routine and recreational activities. 			<content:encoded><![CDATA[<p>Every year, patients in Georgia are the victims of medical negligence or malpractice at the hands of doctors, nurses, or other medical staff. While most of our medical providers maintain a high degree of professionalism and competence, there are still numerous instances in which medical errors and personal injuries can occur. Here are five of the most commonly encountered examples of medical malpractice:</p>
<ol>
<li><strong>Wrong site surgery.</strong> Believe it or not, surgeons do operate on      the wrong side or wrong organ. You can imagine the horror upon discovering      that the wrong limb was amputated or that a healthy organ was removed by      mistake.</li>
<li><strong>Foreign instrument left inside a body cavity.</strong> Most of these      objects are surgical sponges, and surgical staff must conduct sponge and      instrument counts with every surgery. Some patients retain these objects      for months or years while suffering pain, bowel obstructions, problems      healing and infections. These patients must later undergo emergency      surgery, which can expose them to further infection and possible death.</li>
<li><strong>Misdiagnosis of cancer or other serious condition.</strong> A      misdiagnosis, or a delayed diagnosis, of cancer, heart disease,      appendicitis or any other serious condition can lead to a poor prognosis      or rapid death.</li>
<li><strong>Wrong medication or improper dosage.</strong> Medication errors result      from illegible handwriting, inaccurate transcription or reading, drugs      that sound or look alike, a lack of patient or drug information and      miscalculations in dosing. The wrong drug or dosage can lead to heart or organ      failure or to an emergency situation that can lead to death or serious      injury.</li>
<li><strong>Failure to monitor.</strong> Nurses, anesthesiologists and physicians      must properly monitor a patient's condition during and after surgery. The      failure to note a distressed fetal heartbeat or blood glucose levels      during pregnancy can lead to birth defects or injury to the mother.</li>
